Terms and conditions

Your agreement with us consists of these terms and the information you received when ordering, such as price and description of the content.

Buyer: The consumer who creates an account and/or places an order. Below we use buyer or you as applicable.

You must create a user account to use the service. You must be 18 or older to register. You are responsible for providing correct information and for keeping your password confidential. Contact us immediately at magnus@jackfilmbyra.no if you suspect that someone else has gained access to your account.

The service is a streaming service providing access to a curated selection of Norwegian art film. You rent individual films with no subscription commitment.

Rented content is available for 48 hours from the time of purchase. During that period you may watch the film as many times as you wish.

The service is only available from Norwegian IP addresses unless otherwise stated.

You need a stable internet connection and a supported device and browser. We are not responsible for interruptions caused by inadequate equipment, software or internet connection on your side.

The price shown for renting individual films is the total price you must pay. All rental prices are in Norwegian kroner and include VAT. Prices may change from time to time; the price in force is always the one shown at the time of ordering.

Where offered in checkout, you may voluntarily choose to pay a higher amount than the stated rental price (pay-what-you-want). That amount is still a film rental and includes VAT.

In checkout you may also give voluntary support (a donation) to the artist behind the film. That support is a gift to the artist, not part of the rental price, and is charged at 0% VAT. The full amount goes to the artist.

Charges from your internet provider for data traffic are not included and are a matter between you and your operator.

The contract is binding on both parties when you have submitted your order. It is nevertheless not binding if there was an obvious clerical or typing error in our offer and you realised or should have realised that such an error existed.

Payment is made at the time of ordering via the payment methods available in checkout at any given time (including card and Vipps). Access to the content is granted after payment is confirmed. Purchasers under 18 cannot use subsequent invoice payment.

When you rent digital content you receive a non-exclusive, personal and non-transferable right to view the content for private use. You may not copy, distribute, resell, perform publicly or otherwise exploit the content commercially. All intellectual property rights in the films belong to the respective rights holders.

Under section 22 (n) of the Right of Withdrawal Act, the right of withdrawal does not apply to digital content not supplied on a physical medium if you have agreed in advance that performance may begin during the withdrawal period and acknowledged that the right of withdrawal then lapses.

By completing a purchase you confirm and consent that access to the digital content begins immediately after confirmed payment, and that the right of withdrawal lapses from that time.

If we do not give you access to the content after confirmed payment, and this is not due to circumstances on your side, you have a right of withdrawal within 14 days from conclusion of the contract. You may then request a refund without stating reasons by written notice to magnus@jackfilmbyra.no.

Regardless of the withdrawal period, you may under chapter 5 of the Consumer Purchase Act withhold the purchase price, demand performance, cancel the contract and/or claim damages.

Claims should preferably be made in writing, for example by email to magnus@jackfilmbyra.no.

If you fail to pay or meet your other obligations, and this is not due to circumstances on our side, we may under chapter 9 of the Consumer Purchase Act withhold access to the content, demand performance, cancel the contract and/or claim damages. We may where applicable claim interest for late payment and debt collection fees for non-payment.

We reserve the right to change the content of the service, prices and technical solutions. Material changes will be notified within a reasonable time. Films may be removed from the catalogue for rights-related reasons outside our control; we are not liable for such loss but will notify you where possible.

We are the controller of the personal data we collect. Unless you consent otherwise, we only collect and store data necessary to perform the agreement, in line with the Personal Data Act and the GDPR. Data is only disclosed to third parties if necessary to perform the agreement or required by law. See our privacy policy for full information.

Complaints should be sent to us in writing within a reasonable time, cf. section 10. We will try to resolve any dispute amicably. If that fails, you may contact the Norwegian Consumer Authority for mediation on +47 23 400 600 or at www.forbrukertilsynet.no
